By using and/or visiting the www.chicagomicrofresh.com website and/or any sub-website of www.chicagomicrofresh.com, including all content available through any website provided by Chicago Microfresh Farm, LLC, you understand that you are subjecting yourself to these Terms and Conditions and the Chicago Microfresh Farm, LLC Privacy Policy, which are published at www.freshsourcefarms.com. If you do not agree to these Terms and Conditions or the Privacy Policy, please do not use any website provided by Chicago Microfresh Farm, LLC. Please read this entire agreement carefully and print it if you feel the need to do so. Chicago Microfresh Farm, LLC may modify the Terms and Conditions at any time, without notice, and you will be bound to any such modification(s) once the modified Terms and Conditions is posted to www.chicagomicrofresh.com. Therefore, it is important that you review the Terms and Conditions regularly to ensure you are aware of any changes.

 

ELIGIBILITY 

 

By using any Chicago Microfresh Farm’s service, you agree that all registration information you have submitted is truthful and accurate. You are responsible for the ongoing accuracy of said information. You must be at least 18 years of age or older. Your use of Chicago Microfresh Farm does not violate any applicable law or regulation. Chicago Microfresh Farm reserves the right to terminate your account, delete your account, and delete and cancel orders or deliveries at any time without warning, and without refund, if you are violating any of the rules of this Terms and Conditions.

 

PROVIDED SERVICES

 

Subject to full compliance with the Terms and Conditions, Chicago Microfresh Farm will provide certain services. These services include, but are not limited to the ability to be able to place orders online for both pickup or delivery. Please note that some services are only available to users who have subscribed to said services and are possibly paying fees for said services. These services are provided by Chicago Microfresh Farm AS IS and Chicago Microfresh Farm assumes no responsibility for any failure in providing the services to the users. Chicago Microfresh Farm may add, update, or remove any service at anytime, for any reason, without warning. Chicago Microfresh Farm may limit your access to any service at any time, for any reason, without warning. Chicago Microfresh Farm may change fees for the use of services or part of them at any time, for any reason, without warning.

 

GENERAL

You accept sole responsibility for all of your activities using any website provided by Chicago Microfresh Farm, LLC, including your conduct on the site and any and all content you may submit post or share. You will not use any Chicago Microfresh Farm service for any unauthorized or illegal purpose. You will be responsible for ensuring that you do not violate any laws of your jurisdiction, including but not limited to copyright laws. You will not upload or transmit viruses, worms or any other destructive code.

 

You may not use Chicago Microfresh Farm to post or upload any of the following items:

 

  • Viruses, corrupt data, spyware, adware, or any other type of harmful file

  • Copyrighted Content

  • Pirated software or content

  • Content that is illegal or would create liability

  • Slanderous or libelous material

  • Private information of any third party (Email addresses, Social Security Numbers, etc.)

  • Any pornographic or inappropriate image, video, sound bite, etc. (We retain the right to judge what is and is not inappropriate.)

 

The Chicago Microfresh Farm team is very proud of all the effort put into creating our logo and designs, graphics, pictures, text, information, and any other content, which has allowed us to create our service. The property is owned by Chicago Microfresh Farm, and by agreeing to these terms you claim that you will respect our Trademarks and Brands.

 

Any disputes to this agreement will be settled by Illinois laws and Illinois courts.

 

We are not liable for any indirect, consequential or punitive damages, losses of product, and losses of revenue.

 

We think we have a great useful system, but we are not perfect. You understand, agree and fully accept that this site may not be free of errors, and the site may crash or otherwise be unavailable because of server problems, equipment failures, human error or any other reason. We are not responsible for any special, incidental or consequential damages, even if due to negligence, arising out of or connected with the use of this site. You understand, agree and fully accept that we have a small staff and there may be delays in updating, in answering inquiries, fixing system errors and problems, and other services and actions. We may at any time in our sole discretion modify or discontinue the site, or any part of it, add to the site, terminate or suspend your use of or access to the site, and/or modify this agreement. If we modify this agreement, we will try to post the changes promptly, and you may choose to terminate your use of the site. Your continued use constitutes acceptance of the then current terms and conditions of this agreement.

 

If you are a resident of California you specifically waive California Civil Code Section 1542 which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."

 

We respect copyright, and we expect you to as well. If you are a copyright owner and you feel that certain content is infringing on your copyrights, please contact us.

PURCHASES

 

If you wish to purchase products and/or services on this website, you will be asked to supply certain information including credit card information. By making such a purchase, you agree to pay all charges (including shipping and handling or delivery, if applicable) incurred by users of your credit card. This site is not intended for or directed to persons under the age of 18. Chicago Microfresh Farm does not sell products for purchase by children. By registering with this web site, purchasing products from Chicago Microfresh Farm or providing Chicago Microfresh Farm with any information, you represent to Chicago Microfresh Farm that you are 18 years of age or older. If you are under 18, you may use a Chicago Microfresh Farm site only with the involvement of a parent or guardian. Chicago Microfresh Farm reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders for any reason. Purchases that you elect to make at a Chicago Microfresh Farm web site will appear on your credit card bill as: Chicago Microfresh Farm.

 

Fulfillment of the products purchased on this website will be made by Chicago Microfresh Farm LLC, 332 S Michigan Ave, Suite 121-2244, Chicago, IL 60604.

 

PRICING + OTHER TERMS

 

Products cannot be redeemed for cash. Prices and availability of the products and services listed on this site are subject to change without notice. In the event a product or service is listed at an incorrect price or other incorrect information in a listing or listing details and dates due to a typographical error or error in information, we shall have the right to refuse or cancel any order placed for such product or service at the incorrect price, even if the order has been confirmed and/or your credit card has been charged. If your credit card has already been charged for the purchase and your order is canceled, we shall promptly issue a credit to your credit card account in the amount of the incorrect price and notify you of this occurrence.

 

SHIPPING + DELIVERY LIMITATIONS

 

Chicago Microfresh Farm does not ship produce. When an order is placed, it is your responsibility to ensure that you live within the designated delivery area. If an order is placed for a delivery address outside of our delivery area, it will not be shipped and it will not be delivered. Your credit card will be refunded for the original purchase price, minus a $5.00 USD fee for having to remove said order. Deliveries will be made to an address designated by the purchaser if that shipping address is correctly provided. If you choose to pick up your order, it is your responsibility to arrive within the time window that was specified by your order. It is not and will not be our responsibility to wait for you to arrive if you are more than 20 minutes late of your pickup time. Chicago Microfresh Farm delivers products to individual addresses. It is your responsibility to provide an accurate address during the checkout process. It is also your responsibility to provide our drivers with a cooler or purchase a cooler from Chicago Microfresh Farm to be left outside so your produce can remain fresh if you are not home. We will not enter your home, or a locked gate, or any kind of locked/closed barrier. It is your responsibility to provide us with an avenue to provide delivery. Risk of loss for items purchased from this web site are passed to you upon delivery of the items to your location. Products will not be replaced if they are stolen by an unauthorized user, including use as a result of inaccurate or incomplete delivery information provided by the purchaser.

 

DELIVERY AND ORDERING TERMS

 

All orders placed between Monday morning and Wednesday (midnight) will be delivered the following Friday.

 

All orders placed between Thursday morning and Sunday (midnight) will be delivered the following Tuesday.

 

We deliver your order in one or more plastic containers which you may reuse many times. Please be sure to place a cooler (with ice or ice packs) outside in an obvious place the night before your next delivery, so our driver can place your order in the cooler. It is best to designate one spot to leave the cooler, and ideally this will be where the driver will leave your order too. Please specify this in the "Delivery Instructions" field at checkout when filling in your address. If for any reason you do not receive your box by 9:00 pm on the scheduled delivery day, please get in touch with us right away and we will locate your order and get it to you as soon as possible.

 

ACCEPTANCE OF PRODUCT

 

Chicago Microfresh Farm offers fresh produce for sale. Chicago Microfresh Farm is not responsible for the life span of any produce beyond one week of harvest date. There are no refunds or returns.

 

Chicago Microfresh Farm is not responsible for any allergic reactions or illnesses that result from consuming any of our products.

 

Chicago Microfresh Farm reserves the right to make changes to this site and these disclaimers, terms, and conditions at any time without notice. You may contact us with any further questions or concerns.
